Backdated Sick Note in Germany 2026: What Applies

In Germany, a doctor can backdate a sick note by up to three calendar days, but only under strict conditions and with no guarantee. The 3-day rule is narrower than many think, and you still have to notify your employer of sickness immediately.

Monday, 8:30 a.m. It is your first working day after a weekend you spent in bed with a fever. Now you are at the doctor's and realise that the sick note only applies from today. The days before? Nothing. This is where a legal minefield begins for many employees in Germany. Can you get a backdated sick note, and what is allowed? The answer is more complex than most people think.

A backdated sick note does not only affect your right to continued pay. It also has an impact on holiday entitlement, sickness benefit payments and the relationship of trust between employer and employee. This article shows you which rules actually apply under German law, which myths are going around and how to act in a legally sound way.

What does a backdated sick note mean?

Definition and legal classification

A backdated sick note is a medical certificate of incapacity for work (Arbeitsunfähigkeitsbescheinigung, AU) issued for a period before the actual visit to the doctor. The treating doctor certifies that you were already unfit for work in the previous days, even though the medical examination only takes place afterwards.

The legal basis is the Incapacity for Work Guideline (Arbeitsunfähigkeits-Richtlinie, AU-Richtlinie) of the Federal Joint Committee (Gemeinsamer Bundesausschuss, G-BA). It sets out the conditions under which doctors may issue a certificate retroactively.

Difference between notifying sickness and the AU certificate

Many people confuse notifying your employer of sickness (Krankmeldung) with the certificate of incapacity for work. These are two different obligations:

The sickness notification is the information you give your employer without delay that you are unfit for work. This duty to notify follows from § 5 (1) sentence 1 EntgFG, the Continued Remuneration Act (Entgeltfortzahlungsgesetz, EntgFG), and must be fulfilled on the first day of illness, ideally before work starts.

The certificate of incapacity for work is the medical certificate that proves the sickness notification. By law, it only has to be submitted from the fourth calendar day. However, employers can ask for a certificate earlier, and many do so in their employment contracts.

The doctor's role in the assessment

Doctors bear a special responsibility for backdated sick notes. They have to assess, based on objective criteria, whether the incapacity for work already existed before the visit. The decisive factors are:

  • Medical findings: Visible symptoms, the course of the illness and examination results must make a past incapacity for work plausible. With purulent tonsillitis, for example, it is clear that it cannot have started only on the day of the examination.
  • Duty to document: Every assessment must be documented in the patient file in a traceable way. In case of doubt, this documentation serves as proof for health insurers and the Medical Service (Medizinischer Dienst).
  • Medical discretion: The decision ultimately lies with the treating doctor. The doctor is not obliged to issue a backdated certificate, even if you plausibly describe having been ill before.

Is a backdated sick note allowed in Germany?

Principle: the exception, not the rule

The answer is: yes, but only under strict conditions. According to § 5 (3) of the AU Guideline of the Federal Joint Committee, doctors should in principle certify incapacity for work only from the day of the examination.

Backdated sick notes are the exception, not the rule. They are only permissible if the doctor can clearly establish that the incapacity for work already existed beforehand. This finding must be medically traceable and documented in the patient file.

Exceptions under the AU Guideline

The AU Guideline does not name specific exceptions but leaves the assessment to the doctor's discretion. In practice, the following situations are considered justifiable:

  1. Serious illness: You were so ill that a visit to the doctor was not possible, for example with a high fever or being bedridden.
  2. Practice closing times: A visit to the doctor was not possible because practices were closed, for example at the weekend or on public holidays.
  3. Objectively verifiable illnesses: Illnesses with clear symptoms such as broken bones, severe infections or visible injuries.
  4. Appointment problems with known patients: You are known at the practice and the doctor can assess your state of health based on previous treatment.

Medical discretion and burden of proof

Doctors must check three conditions before issuing a backdated certificate:

Medical plausibility is the most important criterion. The course of the illness must be traceable. With a viral illness that typically runs over several days, a past incapacity for work can be justified medically.

Documentation must be complete. Every step of the examination and assessment is recorded in the patient file. Health insurers can request these records.

The credibility of your account plays a role. Contradictions between what you say and the medical findings lead to a backdated certificate being refused.

How many days can a sick note be backdated in Germany?

The 3-calendar-day rule

In practice, a limit of a maximum of three calendar days before the doctor's visit has become established. This rule of thumb is derived from the AU Guideline and medical practice.

The three-day rule includes weekends and public holidays. If you are examined on Monday, the sick note can be backdated to Friday at the earliest.

🔥 Important 🔥

These are calendar days, not working days!

Longer backdating is only possible in absolutely exceptional cases and must be specifically justified. Examples are hospital stays where the admission papers prove the incapacity for work, or documented quarantine orders.

Why this time limit exists

The three-day limit serves several purposes:

Medical assessability: After three days, typical courses of illness can still be reconstructed reliably. For longer periods, the assessment becomes increasingly speculative.

Protection against abuse: The time limit makes improper backdating more difficult. Employers and health insurers can better check whether a certificate is plausible.

Legal certainty: A clear time limit gives everyone involved planning certainty. Employees know what to expect, and employers can plan accordingly.

Typical misconceptions about backdating

A common misconception concerns the "7-day rule". It does not relate to backdating, however, but to the maximum duration of an initial certificate issued via video consultation. Mixing up these two rules often leads to false expectations.

Another misconception: the three-day rule is not a guarantee. Even if you only go to the doctor on the third day, you have no legal right to a backdated sick note. The decision lies with the doctor.

Some believe that sick notes issued by phone can be backdated. That is wrong. Sick notes by phone, which have been permanently possible since December 2023, only apply to future days of illness, never retroactively.

Notifying sickness late vs. a backdated sick note

Notifying your employer: the duty to act without delay

Notifying sickness and getting a sick note are two separate processes with different legal requirements. You must notify your employer without delay. This means without culpable hesitation, as soon as you know you are unfit for work.

In practice, this means you must inform your employer on the first day of illness, ideally before work starts. Late notification is considered a breach of duty and can have consequences under employment law, even if you later submit a valid AU certificate.

The duty to notify also applies if you do not yet have a medical confirmation. So you cannot wait until your doctor's appointment but must let your employer know immediately.

What happens if you report sick late?

The consequences of late notification are graded:

First breach of duty: Usually a formal warning (Abmahnung). The employer documents the incident and reminds you of your obligations.

Repeated breaches: If you repeatedly report sick late, you may face dismissal. Employers have a legitimate interest in timely information for organising work.

Continued pay: Continued remuneration does not depend on timely notification. Even if you report late, you are entitled to continued pay as long as you submit a valid AU certificate later.

The AU certificate as a medical document

The certificate of incapacity for work has a different function from the sickness notification. It serves as medical proof of incapacity for work and is issued by the doctor.

Since January 2023, it has been transmitted electronically (eAU). The doctor's practice sends the AU data to your health insurer, which in turn makes it available to your employer. In most cases you no longer have to hand in paper; you only have to make sure that you see a doctor and get the certificate issued.

Important: even though transmission is electronic, your duty to notify your employer of sickness without delay remains. The eAU does not replace the duty to inform on the first day of illness.

Retroactive sick notes: typical cases in practice

Illness at the weekend

You fall ill on Saturday morning, and your GP's practice is closed until Monday. Can you get a sick note on Monday backdated to Saturday?

In principle, yes, if the medical conditions are met. The lack of access to medical care at the weekend is considered a reasonable explanation for the late visit to the doctor.

Condition: The course of the illness must make it plausible that you were already unfit for work at the weekend. This is usually the case with acute illnesses with clear symptoms.

Alternative: If you have severe symptoms, use the out-of-hours medical service on 116117. It can also be reached at weekends and can issue a certificate directly.

Doctor's appointment only on the next working day

You wake up ill on Thursday but only get a doctor's appointment on Friday afternoon. Can the sick note be backdated to Thursday?

In most cases, yes, if you stay within the three-day period and the illness is traceable. A one-day gap between the onset of illness and the visit to the doctor can be assessed well medically.

Recommendation: Document why you could not see a doctor earlier. Confirmation from the practice that no appointments were available can be helpful but is not strictly required.

Sickness notification: Remember that you still have to inform your employer on Thursday. The later medical certificate does not change this obligation.

Working from home with mild symptoms

You work from home and notice mild symptoms. You continue working at first, but after two days you realise that you are no longer fit for work. Is a backdated sick note possible?

Problematic and usually not permissible. If you actually worked, you were by definition not unfit for work. A backdated certificate for days on which you were working productively contradicts medical logic.

Exception: You worked against medical advice or despite being objectively unfit for work. This happens, but it does not change the actual incapacity for work. Here the doctor can decide case by case.

Best practice: Report sick as soon as you notice that you are no longer fully able to work. Presenteeism when working from home harms your health and makes a retroactive certificate more difficult.

Backdated incapacity for work with mental illness

Mental illnesses such as depression or burnout often develop gradually. Those affected sometimes only realise with a delay that they are unfit for work. Are backdated sick notes possible here?

In principle, yes; the same rules apply as for physical illnesses. The treating psychiatrist or psychotherapist must be able to assess since when the incapacity for work has existed.

Special feature: With mental illness, the assessment is more complex. Therapists who have known you for some time can assess the course of the illness better than doctors seeing you for the first time.

Time frame: The three-day rule applies here too. Longer backdating requires comprehensive documentation, for example therapy records or hospital referrals.

Consequences for continued pay and employment law

Entitlement to continued pay under the EntgFG

The entitlement to continued pay during illness follows from § 3 of the Continued Remuneration Act. Employers must continue to pay wages for up to six weeks if you fall ill and become unfit for work through no fault of your own.

🔥 Important 🔥

A backdated sick note counts for continued pay in exactly the same way as a regular AU certificate. The entire certified period counts towards the six-week period.

Conditions for the entitlement:

  • Incapacity for work through no fault of your own
  • Proper sickness notification to the employer
  • Timely submission of the AU certificate (from the 4th day at the latest)

The electronic AU certificate has simplified this process. Since 2023, employers have been able to retrieve the data directly from the health insurer as soon as the doctor has transmitted it.

When employers may refuse continued pay

Employers can refuse continued pay under certain circumstances:

Missing or late AU certificate: If you do not meet the statutory or contractually agreed deadline for submitting the certificate, the employer may withhold payment until you submit the AU.

Doubts about the incapacity for work: If there are justified doubts, the employer can involve the Medical Service via the health insurer. This is particularly the case with conspicuous patterns, such as frequent sick notes directly before or after the weekend.

Self-inflicted incapacity for work: If the incapacity for work was caused by alcohol, drugs or risky behaviour, the entitlement lapses under § 3 (1) sentence 1 EntgFG.

Why a correctly issued AU certificate matters

A properly issued certificate of incapacity for work has high evidential value. In principle, employers must accept the certified incapacity for work.

Evidential value: The AU certificate carries a presumption. The employer bears the burden of proof if they want to challenge the incapacity for work.

Limits: The evidential value can be shaken. Indications of this are:

  • Conspicuous timing patterns (always ill on Mondays or Fridays)
  • Backdating that exactly covers the notice period
  • Contradictions between the clinical picture and visible behaviour

Review procedure: If there are justified doubts, the health insurer can obtain an expert opinion from the Medical Service. This procedure costs the employer nothing and is carried out under § 275 SGB V (Social Code Book V, Sozialgesetzbuch V).

What employers and employees should keep in mind

Clear internal processes for reporting sick

Employers should establish transparent rules for reporting sick:

Set deadlines: Use your right under § 5 EntgFG to require earlier submission of the AU certificate. Many companies require a certificate from the first day of illness. This requirement must be set out in the employment contract or a works agreement.

Define communication channels: Specify how employees should report sick. Is an email sufficient? Does the HR department or the direct manager have to be informed? Clear rules avoid misunderstandings.

Implement the eAU process: Make sure your payroll software can retrieve electronic AU data from health insurers. Train your HR department accordingly.

Documentation and transparency

Both sides benefit from careful documentation:

For employees: Keep evidence that justifies a backdated sick note. This includes:

  • Screenshots of appointment booking systems showing that no earlier appointments were available
  • Confirmation from the practice about closing times
  • In the case of serious illness: proof of emergency treatment or medication purchases

For employers: Run absence management that recognises patterns. Software can help you here without having to check every individual case manually. Pay attention to data protection rules (GDPR).

Transparency builds trust: If you notice anything unusual, talk to the employee before taking formal steps. There is often a reasonable explanation.

Recommendations for both sides

For employees:

Report sick to your employer immediately on the first day of illness, even without a medical certificate. This duty to notify does not depend on your doctor's appointment.

If you have serious symptoms, see a doctor promptly. The earlier the examination, the easier the assessment. If necessary, use the out-of-hours medical service on 116117.

Communicate openly if you do not get a backdated certificate. Your employer can then decide how to handle the situation. Many companies show goodwill in understandable individual cases.

For employers:

Respond to late sickness notifications in a differentiated way. A single lapse usually does not justify drastic measures. Talk to the employee first.

If there are systematic irregularities, use the option of involving the Medical Service. This is your right and protects against abuse without you having to take action yourself.

Train your managers in handling sickness notifications. They are the first point of contact and should know the most important rules.

Conclusion

A backdated sick note in Germany is not automatic but an exception with narrow limits. The three-day rule gives employees some leeway, but it does not replace notifying the employer without delay.

Doctors bear a high level of responsibility when backdating. They must assess, based on objective medical criteria, whether a past incapacity for work is credible. This assessment is at their discretion and cannot be enforced in court.

For employees, this means: if you want to act in a legally sound way, report sick on the first day of illness and see a doctor promptly. For employers: clear processes and transparent communication build trust and minimise conflict.

The electronic certificate of incapacity for work has simplified a lot. But the basic obligations remain: notifying sickness without delay, seeing a doctor in good time and mutual trust as the basis of a working employment relationship.

FAQs

Can a doctor in Germany backdate a sick note?

Yes, doctors in Germany can backdate a sick note, but only under strict conditions. The Incapacity for Work Guideline (AU-Richtlinie) of the Federal Joint Committee allows a backdated sick note for a maximum of three calendar days before the doctor's visit. The doctor must be able to establish in a medically traceable way that you were already unfit for work on those days, based on clear symptoms, a plausible course of illness or objective findings. The decision is at the doctor's discretion and must be documented.

How far back can a sick note be backdated in Germany?

In Germany, a sick note can be backdated by a maximum of three calendar days before the doctor's visit. This three-day rule has become established in practice under the Incapacity for Work Guideline and includes weekends and public holidays. Longer backdating is only permissible in absolutely exceptional cases, such as documented hospital stays or quarantine orders. Important: there is no legal right to a backdated certificate, even if you see a doctor within the three-day period.

What is the difference between notifying sickness and a backdated sick note?

Notifying sickness (Krankmeldung) and a backdated sick note are two separate processes. Notifying sickness means informing your employer without delay that you are unfit for work, which must happen on the first day of illness. A backdated sick note, by contrast, is the medical certificate of incapacity for work issued afterwards for past days. You cannot notify your employer retroactively, because the duty to notify under § 5 of the Continued Remuneration Act (Entgeltfortzahlungsgesetz, EntgFG) applies immediately; late notification counts as a breach of duty even if you later submit a valid backdated AU certificate.

Do I get continued pay with a backdated sick note?

Yes, with a valid backdated sick note you are entitled to continued pay for the entire certified period. The entitlement under § 3 of the Continued Remuneration Act (EntgFG) applies regardless of whether the certificate was issued on the day of illness or retroactively, provided the certificate meets the legal requirements and you have fulfilled your duty to notify. The backdated period counts towards the six-week period of continued pay. If there are justified doubts, the employer can involve the health insurer, which then asks the Medical Service (Medizinischer Dienst) to review the case.

What happens if I report sick to my employer too late?

Reporting sick late counts as a breach of your contractual duties and can have consequences under German employment law. A first breach usually results in a formal warning, while repeated breaches can lead to dismissal. Late notification does not affect your entitlement to continued pay as long as you submit a valid certificate of incapacity for work later. You must notify your employer without delay, i.e. without culpable hesitation on the first day of illness, and a backdated sick note from your doctor does not excuse late notification.

Can I get a sick note on Monday backdated to the weekend?

In principle, yes, if the medical conditions are met and the three-day rule is observed. If you fall ill on Saturday morning and see a doctor on Monday, the doctor can backdate the sick note to Saturday, provided the course of the illness makes it plausible that you were already unfit for work at the weekend. Lack of access to medical care at the weekend is considered a reasonable explanation for the late visit. If you have severe symptoms, however, contact the out-of-hours medical service on 116117, which can also issue a certificate at the weekend.
